OFFICIAL RULES AND WAIVER
Eligibility: The 2012 Cover Search (”Contest”), sponsored by Little Black Dress | Little Red Wagon Magazine (”Sponsor”) is open to legal residents of the United States, age 21 or older at time of entry. Contest is subject to all applicable federal, state and local laws and regulations.
Prizes: There will be one (1) Grand Prize and three (3) Runner-Up Prizes offered. A photo session is included in the Grand Prize, which will be scheduled between March 15-25 (photographs from this session, as selected by the Editor, will appear on the covers of Little Black Dress | Little Red Wagon Magazine). All costs and expenses associated with acceptance and use of the Grand Prize not specified herein as being provided, including but not limited to taxes, gratuities, incidentals, upgrades and service charges are the responsibility of the Grand Prize Winner.
Grand Prize Winner (mom + children) must be available for photo shoot on dates specified by Sponsor (March 15-25, 2012). Prizes must be used/redeemed no later than the date specified by Sponsor or prizes will be forfeited and Sponsor will have no further obligation to Grand Prize Winner. All prizes must be redeemed/used within seven (7) months of announcement of winner (or by November 1, 2012).
If any of these criteria are not met by Grand Prize Winner, and there is sufficient time to award prizes to an alternate winner, an alternate winner may be chosen at the discretion of the Sponsor.
Selection of Winner: The potential Winner will be selected based on online voting (voting will be open on blackdressredwagon.com, Facebook and Bandwagon mobile app between 10 a.m. on March 3 and 11:59 p.m. on March 11, 2012), as well as by a panel of judges. Website, Facebook, Bandwagon and judges panel will each bear one-fourth the weight toward determining the winner. Entrants may solicit votes from friends and family, and individuals may vote an unlimited number of times for an unlimited number of contestants. Sponsor reserves the right to disqualify an entrant for any reason, without explanation.
Notification of Winners: The potential Grand Prize Winner, as well as the three runners up, will be notified by email or phone, and may be required to reply within 48 hours (2 days) of date of winner notification, as well as sign and submit a Liability Waiver, releasing Third Party Entities and each of their respective affiliates and employees from any and all liability, claims, demands, judgments, and causes of action for personal injury and/or damage, theft, or loss suffered in connection with this Contest or the use or acceptance of any prize awarded in this Contest. If Waiver is not timely returned fully-executed, a prize notification or prize is returned as undeliverable, Sponsor is unable to contact a potential winner within a reasonable time period or a potential winner is not in compliance with these Official Rules, the prize will be forfeited and, at Sponsor’s discretion, awarded to an alternate winner from among all remaining eligible entries.
All prizes (gift certificates, etc.) will be awarded within approximately fifteen (15) days after the winner is verified. If a prize notification is returned as undeliverable, it will result in disqualification, and the prize will be awarded to an alternate winner in a separate random drawing. Prizes are non-assignable or transferable to another individual.
General Prize Conditions: Prizes are non-assignable or transferable to another individual. Prizes are not redeemable for cash, and no substitution is permitted except if prize offered is unavailable, in which case a prize of equal or greater value will be awarded, at the discretion of the Sponsor. Winner is responsible for all federal, state, local taxes. Winner acknowledges that the Sponsor and all other businesses affiliated with this Contest and their agents do not make, nor are in any manner are responsible for any warranty, representations, expressed or implied, in fact or in law, relative the quality, conditions, fitness or merchantability of any aspect of the prize(s) being offered, except that each prize shall be subject to its provider’s standard warranty (if any). Entry and acceptance of any prize constitutes permission for Sponsor and its designees to use winner’s name, prize won, hometown and likeness for advertising and promotional purposes in any and all media now or hereafter devised, including online posting, worldwide in perpetuity, without further compensation, notification or permission, except where prohibited by law.
General: Entrants agree to (i) be bound by these Official Rules, including all eligibility requirements, and the decisions of The US Sweepstakes & Fulfillment Company and the Sponsor, which are final and binding in all matters relating to this Contest, and (ii) release the Sponsor and all prize sponsors and their respective parents, affiliates, subsidiaries, advertising and promotion agencies, and all other businesses involved in this Contest, as well as the employees, officers, directors and agents of each (collectively, “Released Parties”) from all claims and liability relating, in whole or in part, directly or indirectly, to their participation in the Contest and/or the acceptance and use/misuse of a prize (including any travel or activity-related thereto). Released Parties are not responsible for: (i) lost, late, misdirected, damaged, inaccurate, incomplete, delayed, misdirected, illegible or postage-due entries or mail; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes or in any Contest-related materials; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Contest. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Contest. Sponsor reserves the right to: (i) permanently disqualify from any Contests it sponsors any person it believes has intentionally violated these Official Rules or has acted in a unsportsmanlike or disruptive manner (and void all associated entries); and (ii) withdraw the online method of entry if it becomes technically corrupted (including if a computer virus or system malfunction inalterably impairs its ability to conduct the Contest) or terminate the Contest in its entirety, and (i) if only online method is withdrawn, to select winner from among all non-suspect eligible online entries received prior to withdrawal and all mail-in entries received for the entire Contest Entry Period combined, and (ii) if Contest is terminated in its entirety, to select winner from among all non-suspect eligible entries received prior to termination.
Terms: By entering and providing the required entry information, entrants acknowledge acceptance of the above rules and guidelines, and promise to abide by stated Contest regulations.
